1. Agreement to Terms

By accessing or using SIXTA's website (sixta.ai) or services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our services.

2. Description of Service

SIXTA is an autonomous database reliability engineering (DBRE) platform that deploys inside your infrastructure. The platform provides:

• Database Telemetry: Direct read-only connection to MySQL and PostgreSQL instances, with optional ingestion from monitoring tools such as AWS CloudWatch, Performance Insights, and Percona PMM
• Anomaly Detection & Root Cause Analysis: Baseline learning, pattern recognition, and automated diagnosis of database incidents
• Proactive Monitoring: Detection of regressions, capacity trends, and emerging issues before they become outages
• Knowledge Capture: Institutional memory that documents every investigation, root cause, and resolution for future reference
• Progressive Trust: A three-level autonomy model (Observe, Recommend, Act) where permissions are expanded at your discretion

SIXTA delivers findings and recommendations via Slack or Microsoft Teams. Currently in early access with founding partners.

3. Eligibility

To use our services, you must:

• Be at least 18 years old
• Have the legal authority to enter into these Terms
• Provide accurate and complete information
• Not be prohibited from using our services under applicable laws

4. Account Responsibilities

When you create an account with us, you agree to:

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Keep your contact information current

5. Acceptable Use

You agree not to:

• Use our services for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Reverse engineer or attempt to extract source code
• Use our services to harm or exploit others
• Violate any applicable laws or regulations

6. Intellectual Property

Our Property

All content, features, and functionality of SIXTA services, including software, text, images, and logos, are owned by SIXTA and protected by international copyright, trademark, and other intellectual property laws.

Your Data

You retain all rights to your data. By using our services, you grant us a license to process your data solely to provide and improve our services.

7. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. We are committed to protecting your data and complying with applicable data protection laws including GDPR.

8. Beta Services and Founding Partner Program

As a founding partner or early access user:

• Services are provided "as-is" during the beta period
• Features may change or be discontinued
• You agree to provide feedback to help improve our services
• Special pricing and terms may apply as communicated separately

9. Disclaimers

Important: Our services are provided "AS IS" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by law, SIXTA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11. Indemnification

You agree to indemnify and hold harmless SIXTA and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

12. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use our services will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through our services. Your continued use after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Madrid, Spain.

15. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any separate agreements for specific services, constitute the entire agreement between you and SIXTA regarding our services.
